Legal Help Needed: Subpoena Defense & Trademark Risk
I’m a full-time professional who previously ran a small resale business on the side, which is now in the process of being closed. Years ago, I sold used branded products to another individual, who is now being sued for trademark infringement. That individual allegedly marketed the products as new. I’ve been subpoenaed as a third-party witness in the case and have already produced documents and sat for a multi-hour deposition.
The brand has now filed a motion to enforce the subpoena, seeking additional documents. Their attorneys have also been serving legal documents to both my home and my full-time workplace, which is disruptive and stressful. I’m concerned about potential legal exposure and want to ensure I’m protected moving forward.
- I’m looking for a U.S.-licensed attorney (preferably with experience in trademark law, civil litigation, and negotiation) who can **work with me within a limited budget**. I’ve already spent a significant amount on legal fees and did not anticipate this situation continuing. I need someone who is understanding of my position and can help me navigate this efficiently and affordably.
- *Scope of Work:**
- Advise me on how to respond to the motion to enforce the subpoena for additional documents
- Help ensure I don’t disclose anything that could be self-incriminating or used against me in potential litigation
- Represent or guide me through any court proceedings related to the subpoena enforcement or any other that may arise
- Assist in negotiating a resolution with the brand — ideally, a written agreement where I agree not to sell their products in exchange for them agreeing not to pursue legal action against me
- Draft or review legal responses, objections, or settlement terms
- Address the issue of being served at my home and workplace, and help put a stop to unnecessary or harassing service
- *Ideal Candidate:**
- Licensed to practice law in the U.S. (Texas preferred, but not required if familiar with federal subpoena and trademark procedures)
- Experience with trademark disputes, subpoenas, and third-party witness defense
- Skilled negotiator with a track record of resolving disputes out of court
- Compassionate and practical — able to work within a constrained budget
- Strong communicator who can explain legal risks and options clearly
- Available for consultation and document review on short notice
